Interim Application has been moved urgently in view of the order dated 10th February, 2026 passed by the Collector, Dadra, Nagar Haveli and Silvassa cancelling the sale permission pursuant to the impugned judgment dated 13th August, 2025.

It is not disputed that by order dated 20th November, 2025, First Appeal came to be admitted and ad-interim relief of stay to the impugned judgment was granted. Without noticing the same, the order dated 10th February, 2026 has been passed by the Collector, Dadra, Nagar Haveli and Silvassa.

Learned counsel appearing for the Respondent No.1 fairly states that the application was filed on 12th September, 2025 and was thereafter not pursued. In view of the stay of the implementation and execution of the impugned judgment dated 13th August, 2025, the order of 10th February, 2026 is stayed and no effect be given to the order of 10th February, 2026.

Interim Application is allowed in terms of prayer clause (a). 5.

List the First Appeal along with Interim Application on 7th April, 2026.
