Mr. Gitay, learned Counsel appears for the Appellant/Applicant. He tenders a copy of the letter dated 9th March 2026 showing service of the present Interim Application on the Respondent. A perusal of this letter reveals that the Respondent has in fact received a copy of the Interim Application. Mr. Gitay undertakes to file an Affidavit-of-Service to that effect, on or before 1st April 2026.

The present Interim Application seeks setting aside of an order dated 22nd December 2025 passed by this Court dismissing the Appeal from Order and pending Interim Application therein for want of prosecution and also seeks restoration of the same to the file/record of this Court by condoning the delay of 73 days in filing the present Interim Application. 4.

This Court is satisfied with the reasons set out in the present Interim Application and therefore is of the view that the same is required to be condoned. However, some terms are required to be put to the Appellant for such condonation.

Accordingly, the following order is passed:- : O R D E R :

(i) Subject to the Appellant making payment of a sum of Rs.10,000/- to the High Court Law Library on or before 6th April 2026, and submitting the necessary proof in that regard, the Appeal and the pending Interim Applications shall stand restored to the file of this Court and the delay of 73 days in filing the Interim Application shall hereby be condoned. (ii) Accordingly, the Interim Application is disposed of in terms of prayer clauses (a) and (b).
