The present Application is being filed seeking restoration of the First Appeal (St.) No. 28503 2025 and Interim Application No. 11528 of 2025 which was filed for condonation of delay. The same came to be dismissed for want of prosecution by an order dated 7 March 2026 passed by this Court. 2.

Having perused the averments made in the Application for restoration, this Court is of the view that there is sufficient cause made out for restoration of the appeal and non appearance of the Advocate was not intentional or deliberate. This Court sets aside the order dated 7th March 2026. In view of the above, the Appeal and Interim Application No. 11528 of 2025 are restored to the file of this Court. In view thereof the present Application is allowed in terms of prayer clauses (a) and (b).

The Respondent-Claimant has placed on record a receipt evidencing deposit of Rs. 3,00,000/- before the MACT. Hence, stay granted by order dated 9 th September 2025, shall continue.
