Interim Applications have been preferred for recall of the order dated 11th March, 2026 passed in First Appeals by which the First Appeals came to be admitted and R & P are called for. Talwalkar 1 of

46.FA2236.2025.doc 2.

Present applications have been preferred at the instance of the Respondent No. 4 who was duly represented by Advocate when the order of 11th March, 2026 was passed. As the proceedings are First Appeals, the same came to be admitted.

The only submission canvassed by the learned Counsel appearing for the Respondent No. 4/Applicant is that the as the Appeals are admitted, it will take years for the appeal to be heard. 4.

Such a submission is clearly misconceived. The order of admission cannot be recalled on such a perception. Admission of the First Appeals does not imply that the appeals will not come up for final hearing in near future. The remedy of Applicant, if aggrieved, is either to challenge the order of admission or file an application seeking expeditious hearing of the Appeals. The order of admission cannot be recalled on such frivolous ground.

In light of above, Interim Applications are clearly misconceived and are dismissed.
