ORDER :

By this Interim Application, the Applicant is pressing for prayer Clause (c) namely, permit the Applicant to continue at his original place of posting at Parel and to retain the official residential accommodation.

The Applicant has stated that on 16th March, 2026, the Applicant has joined the transferred location i.e. ATS Pimpri. 1/2

The Applicant had been placed on suspension vide suspension Order dated 2nd December, 2025 and chargesheet had been issued on 29th December, 2025 by the Respondent. It is upon revocation of the suspension that the Applicant has been transferred to the new location.

The learned Counsel for the Respondent No.1 - Corporation states that the Applicant has his own residence in Bhosri and has been claiming HRA from the Respondent No.1 - Corporation. This has been suppressed in the present Interim Application. 5.

The learned Counsel for the Petitioner has refuted the submission made on behalf of the Respondent that he is availing of HRA for his own residence.

In view of the suppressed fact of the Petitioner having his own residence, prayer Clause (c) which is the only prayer which is pressed is rejected.

Accordingly, the present Interim Application is dismissed. There shall be no order as to costs.
