CIVIL APPELLATE JURISDICTION INTERIM APPLICATION NO. 2950 OF 2026 IN WRIT PETITION NO. 5639 OF 2018 Ravi Prabhudas Mahbubani & Ors.

Respondents ****** Mr. Dormaan J. Dalal and Ms. Shirley Mody for Applicants/ Petitioners.

Mrs. M. S. Bane, AGP for Respondent Nos.1 to 3 and 5-State. Adv. Mrunal Tavade (through V.C.) i/by Little & Co. for Respondent Nos.4 and 6-MIDC.

****** CORAM : MANISH PITALE AND SHREERAM V. SHIRSAT, JJ.

DATE : 4th MAY 2026 P.C. :

.

By this interim application, the applicants (original petitioners) are seeking to amend the writ petition in terms of schedule annexed at Exhibit 'A' to the application. 2.

Although the learned AGP appearing for respondent Nos.1 to 3 and 5-State and the learned counsel appearing for respondent Nos.4 and 6 have opposed the prayer made in the present by BIPIN DHARMENDER PRITHIANI Date: 2026.05.05 14:45:35 +0530 BIPIN DHARMENDER PRITHIANI application, we find that the proposed amendments are for the purpose of taking further the challenge sought to be raised in the

bipin prithiani 68-ia-2950.26.doc main petition itself. In any case, allowing the petition to be amended does not mean that this Court has accepted the contentions sought to be raised in the proposed amendment as the respondents will certainly have an opportunity to file further affidavits to oppose the same. Allowing the amendment merely grants an opportunity to the petitioners to raise the additional grounds, which appear to us to be pure questions of law requiring consideration of this Court.

3.

In view of the above, we find that the respondents will not suffer any prejudice if the application is allowed. Accordingly, the application is allowed in terms of prayer clause (a). 4.

The amendment shall be carried out on or before 12th June 2026. The extended time period has been granted in the light of the fact that this Court would be breaking for summer vacation in the month of May 2026.

5.

The amended papers shall be served upon the respondents within one week of carrying out the amendment. 6.

The respondents shall be at liberty to file additional affidavits within four weeks thereafter.

7.

List the petition for further consideration on 13th July 2026. (SHREERAM V. SHIRSAT, J.) (MANISH PITALE, J.)
