This application has been taken up seeking a short modification to the order dated December 22, 2025. Taking into account the arbitration agreement envisaging a three-member arbitral tribunal, a learned arbitrator had been appointed as a nominee arbitrator on behalf of the Respondent. The Respondent (the Original Petitioner under Section 11) is present in Court in person today.

The parties have consensus on modifying the agreement for a three-member arbitral tribunal and proceeding before the arbitrator May 4 , 2026 Rutuja Borse

3-IA-3019-2026.doc appointed by this Court as the sole arbitrator to enter upon the reference and adjudicate the disputes between the parties.

In these circumstances, the order dated December 22, 2025, is modified with the clarification that the arbitrator nominated by this Court on the last occasion would act as the sole arbitrator to adjudicate between the parties. No other change is effected to the order. 4.
