Interim Application No.3360 of 2026 is filed for restoration of the Family Court Appeal (Stamp) No. 15132 of 2025 by condoning the delay in filing the application. 2.
Heard the learned Counsel for the applicant and perused the proceedings before the Registrar (Judicial II). Time was granted to furnish copies of the appeal and on failure to do Digitally signed by MAMTA AMAR KALE Date:
2026.05.04 16:17:33 +0530 MAMTA AMAR KALE so, it is indicated that the interim application along with appeal shall stands dismissed. Since there was no compliance, the appeal came to be dismissed.

On hearing the learned Counsel for the applicant and perusal of the application, which clearly indicates that the matter was listed before the Registrar for supplying of spare copies but the copies could not be supplied and therefore, the appeal was dismissed. We find substance that inadvertently, the copies could not be supplied. The applicant is desirous of contesting the matter on merits.

In the wake of the pleadings in the application and specifically paragraphs No.4 and 5, we deem it appropriate to restore the appeal to its file for further consideration. However, this shall be subject to cost of Rs.5,000/- to be deposited by the learned Counsel representing the applicant with Kirtikar Law Library.
Subject to the deposit of cost and removal of office objections, if any, within period of four weeks from today, the family court appeal shall restore to file and directed to be listed after summer vacation.

The interim application stands disposed of.
