Heard Mr. Chavan, learned Advocate for Applicant and Ms. D'Silva, learned Advocate for Appellants. Mr. Chavan appears on behalf of Defendant in the Suit proceedings before the Trial Court. 2.
An Application was made by the Defendants in the Trial Court prior to 2020 seeking certain repairs to be carried out in the Suit premises. That Application was dismissed against which Writ Petition was preferred in this Court. The said Writ Petition was disposed of by order dated 27.07.2022. Despite dismissal of the said Writ Petition, Defendant has now filed Interim Application seeking further directions
55.IA.3815.2026.doc from the Court in view of what is recorded in the dismissal order. Such practice is not known to the Court. If the Defendant has any grievance, the said grievance shall be made before the learned Trial Court by taking out an appropriate Application, where the Suit proceeding is pending with regard to seeking any direction qua the Suit premises. That right of Defendant is expressly kept open. 3.
Present Interim Application is therefore dismissed on the above ground.

Needless to state that dismissal of this Application will not came in the way of Defendant to seek appropriate order before the Trial Court in accordance with law.
