This is an Appeal under Section 14-A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (for short "SCST Act") challenging the order dated 02.01.2026 passed by the learned Additional Sessions Judge, Khamgaon, District Buldhana rejecting the Criminal Bail Application No.586/2025 filed by the Appellant for anticipatory bail in Crime No.412/2025 registered with the Khamgaon Police Station for the offence punishable under Sections 3(1)(r), 3(1)(s) and 3(2)(va) of the SCST Act read with Section 126(2), 130, 351(3) and 352 of the Bhartiya Nyaya Sanhita, 2023 (for short "B.N.S.").

After passing of the impugned order, there is a substantial progress in the investigation as seen from the papers made available by the learned A.P.P.

The learned Advocate for the Appellant, therefore, seeks leave to withdraw the Appeal with liberty to file fresh Application before the learned Sessions Court.

In view of the above, Appeal stands disposed of as withdrawn with liberty to file fresh Application for anticipatory bail before the learned Sessions Court in the light of substantial progress in the investigation.

The fees of the learned Advocate appointed for the Respondent No.2 is quantified at Rs.5,000/-. The same shall be paid by the High Court Legal Services Authority, Nagpur.
