DATED :- 24.04.2026 When the matter was called out at 11:00 am today, none appears on behalf of the appellant. Hence, the matter was kept back for taking instructions by the learned APP. Thereafter, at about 12:15 p.m. the matter was again called out but, none appeared on behalf of the appellant.

On the face of record, it appears that the present appellant/accused has invoked the jurisdiction of this Court under Section 14-A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (for short, "Act of 1989") and challenged the order dated 21.01.2026 passed in Criminal Application (ABA) No. 28/2026 passed by the learned Special Judge, SC/ST (PoA), Akola thereby declined to enlarge the appellant/accused on anticipatory bail in connection with RR Jaiswal

2 6-apeal-55-26.odt Crime No. 376/2025 registered with City Kotwali Police Station, Akola for the offences punishable under Sections 75(1), 79, 296, 351(2) of the Bhartiya Nyaya Sanhita, 2023 and Sections 3(1)(r), 3(1)(w)(i)(ii) and 3(2)(va) of the Act of 1989.

Again the matter is called out at about 12:15 pm, the learned APP for the State informed this Court that on 27.02.2026 at about 13:52 hours, the IO arrested the appellant-accused in connection with Crime No. 376/2025 and remanded in custody. The written instructions received by the learned APP is taken on record and marked 'Exh.-X' for identification. Therefore, the cause of action for the present appeal does not survive and the appeal becomes infructuous.

Accordingly, the appeal stands disposed of as infructuous.
