By way of this Application, the Applicant seeks modification of condition (A) of the modified order dated 21st June 2025 passed by the Ad hoc Judge, City Civil Court and Additional Sessions Judge, Mumbai. The modified condition (A) sought to be further modified reads thus: "The Criminal Miscellaneous Application No.1306 of 2025 is allowed.

Condition No.(iii) to remain present before the investigation officer on every Sunday during the period from 11:00 a.m. to 2:00 p.m., till completion of investigation."

Mr. Saurabh Patil, learned counsel for the Applicant, submits that the Applicant has filed a Writ Petition seeking to quash the FIR, which is the subject matter of the bail order. The Division Bench of this Court has restrained the Investigating Officer from filing the charge-sheet without permission of this Court. Hence, the matter has not proceeded before the Trial Court.

For reasons mentioned in the Application and the submissions made by the parties before this Court, I am inclined to modify the said condition to a limited extent. The modified condition shall read thus:

"The Applicant shall remain present before the Investigating Officer on the first Sunday of every alternate month between 11:00 a.m. and 2:00 p.m., till completion of the investigation or further orders." 4.

The Criminal Application is partly allowed and disposed of accordingly.
