This application is filed for temporary modification of condition No.2 in the order dated 13th February, 2026 passed by the Special Court in Bail Application No. 1245 of 2025 in NDPS Special Case No. 86 of 2026.

Learned Counsel for the Applicant submits that the Trial Court granted interim bail for two months to the Applicant in view of the fact that she had delivered a child in the jail. It is her submission that this order came to be passed on 13th February, 2026 and being unable to furnish the solvent surety in the amount of Rs. 1 lakh, the Applicant as well as her child are required to be there in the jail.

Learned Counsel for the Applicant, on instructions, makes statement that for a period of two months, condition No.2 be modified by permitting the Applicant to furnish P. R. Bond of Rs.15,000/- with one surety in the like amount to the satisfaction of the Trial Court.

Learned Counsel for the Respondent submits that she has no instruction to appear in the present application. However considering the facts of the case and urgency made out in the matter, she is requested by the Court to cause appearance in this application being a Panel Advocate. She accepted the request of the Court and made submissions.

She opposed modification. However, it is further submitted on humanitarian ground, if this Court is inclined to modify the said condition, in order to ensure that after a period of two months on the release of the Applicant on bail, she returns to the jail, appropriate conditions to be imposed. She be directed to provide her as well as her husband's residential address so also the address of the workplace. 6.

Learned Counsel for the Applicant, on instructions, undertakes to provide these addresses to the Investigating Officer before actual release on bail.

Considering the fact that Applicant has delivered a child in jail, and on that count she is granted temporary bail by the

Special court, on humanitarian ground the prayer for temporary modification of the above noted condition is necessary. Hence, order :-

ORDER

i) The Applicant be released on bail, on executing P. R. Bond of Rs.15,000/- with one surety in the like amount, to the satisfaction of the Trial Court. ii) As undertaken, Applicant and Applicant's husband to provide their addresses of residence and workspace to the Investigating Officer.

iii) Part of the order passed by the Trial Court to remain unchanged.

In view of the above, Application is allowed in aforestated terms and disposed of accordingly.
