IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 902 CRIMINAL APPLICATION NO. 189 OF 2026 IN APEAL/150/2024 BHAGAJI GANPAT KATKAR ....Applicant

VERSUS

THE STATE OF MAHARASHTRA .....Respondent WITH CRIMINAL APPEAL NO. 150 OF 2024 Mr. P. B. Sopan, Advocate for the applicant Mr. V. K. Kotecha, APP for the respondents/State CORAM : RAJNISH R. VYAS, J.

DATE : 16th JANUARY, 2026 PER COURT :

1.

This is an application for grant of bail and suspension of sentence. It is pertinent to mention here that this court vide order dated 29-07-2024 has rejected an application for suspension of sentence and grant of bail.

2.

Now again on similar grounds application is preferred by the applicant. This time, counsel for applicant submitted that while passing the order dated 29-07-2024, this court has not taken into consideration the statement recorded under section 164 of the Code of Criminal Procedure. In fact, the said statement supports the case of applicant.

(2) 902criapln189.26 3.

Be that as it may, suffice it to say that the application cannot be argued in piecemeal manner. Even otherwise, the order dated 29-07-2024 is a detailed order, in which prima facie material available against the applicant/accused was discussed. 4.

In that view of matter, since there is no merit in instant application, application is rejected.

5.

Since applicant is in jail, hearing of appeal is expedited. [RAJNISH R. VYAS, J. ] VishalK/902criapln189.26
