This application is presented by the applicant / accused under Section 439(1)(b) of Cr.P.C. (or Section 483 of BNSS) seeking the relaxation or modification of condition imposed in the bail order dated 27.11.2025.

By the order dated 27.11.2025, the applicant was granted bail subject to certain conditions, specifically Clause No. (b), which reads thus :- "The Applicant - Om Gulab Shingare, be released on bail on furnishing P.B. of Rs.25,000/- (Rupees Twenty Five Thousands) with two solvent sureties of the like amount, in connection with Crime No.267/2025 registered with the Pundlik Nagar Police Station, Aurangabad for the offences punishable under Sections 109(1), 118(1), 352 and 351(3) of Bharatiya Nyaya Sanhita, 2023,...."

The learned counsel for the applicant submits that the applicant is unable to furnish two sureties to comply with the aforementioned condition. The counsel further submits the applicant is ready to furnish one surety in the like amount and, accordingly, requests for modification of the order. 4.
Upon considering the material on record and the reasons mentioned, this Court is satisfied that the applicant has made out a case for modification in the order. It is well settled that harsh conditions which impede the applicant's liberty may be modified if the interest of justice is still served. As such, the application deserves to be allowed. Hence, following order :-
ORDER
1.
Application is allowed.
2.
Clause No. [b] of the order dated 27.11.2025 is hereby modified as under :- "The Applicant - Om Gulab Shingare, be released on bail on furnishing P.B. of Rs.25,000/- (Rupees Twenty Five Thousands) with one solvent surety of the like amount, in connection with Crime No.267/2025 registered with the Pundlik Nagar Police Station, Aurangabad for the offences punishable under Sections 109(1), 118(1), 352 and 351(3) of Bharatiya Nyaya Sanhita, 2023,...."

Rest of the conditions imposed in the original bail order shall remain intact and unaltered.
