Heard rival submissions. The applicant is presently in Nashik Road Central Prison, Jail Road, Nashik. He is seeking his
2 921.Crl.WP.230.26.odt release on bail for a period of two (2) months for enabling him to undergo prescribed surgery of both the hip joints. He has already produced on record the report from the Primary Health Center, Rahata, mentioning that such surgery is needed. However, learned APP today produced on record medical report of the petitioner dated 25.02.2026, issued by Chief Medical Officer, Nashik Road Central Prison. The same is taken on record and marked 'X' for the purpose of identification.

On going through the said report, it is evident that the Chief Medical Officer has opined that the applicant needs both hip joint replacement surgery which is available at Sir J.J. Group of Hospitals at Mumbai. The learned counsel for the applicant submits that if the applicant is released on temporary bail for the aforesaid period, then he will have to apply before the D.I.G., Prison for raising funds and it will take some time. According to the opinion of private doctor, the applicant will need at least two (2) months period for recovery if the surgery is immediately performed. 3.
In view of the same, we are of the opinion that the applicant can be released on the bail for temporary period as prayed for. In view of the same, the application stands allowed and the applicant be released on execution of his PR bond of Rs.20,000/-
3 921.Crl.WP.230.26.odt (Rupees Twenty Thousand only) with one surety in the like amount from tomorrow i.e. 27.02.2026 for the period of onward 60 days. He shall surrender before the concerned Superintendent of Jail of Nashik Road Central Prison on 29.04.2026 at about 5.00 pm. The application is accordingly disposed of.

The bail be furnished before concerned Superintendent of Jail and the Jail Authority shall act upon the authenticated copy of this order.
