Heard learned advocate appearing for applicants. 2.

Perused FIR. Admittedly, applicants were holding post under establishment of Panchayat Samiti. The allegation is that while implementing scheme, applicants found responsible for illegal disbursement of funds to ineligible institutions. On enquiry by Block Development Officer, they are found guilty.

Learned advocate appearing for applicants contends that applicants were not signatories or authorized officers for disbursement of funds and, therefore, no offence can be made out against them.

It appears that investigation is still in progress. The role of applicants and other accused persons is yet to be crystallized. After completion of investigation only involvement of applicant or their role in commission of offence would be surfaced. At this stage, defence
