The applicant/accused who is convicted for commission of offences punishable under Sections 376-AB, 506 of the Indian Penal Code and Sections 4(2), 8 and 12 of the Protection of Children From Sexual Offences and sentenced to suffer rigorous imprisonment for a period of 20 years has preferred this application for grant of temporary bail.

It is necessary to mention here that this court has already rejected his application for suspension of sentence vide order dated 29-09-2023.

Learned Advocate for the applicant submits that younger sister of the applicant namely Kajal is entering into wedlock on 2601-2026 and venue is 'Samruddhi Lawns', Harsool Sawangi, Jalgaon Road, Dist. Chhatrapati Sambhajinagar. She submits that the applicant being elder brother is required to participate in order to perform certain rituals.

In morning session, I requested the learned APP to enquire from the concerned police station as to whether marriage is fixed on 26-01-2026 and whether concerned lawn is booked. 5.
Learned APP, on instructions, states that she has taken necessary information from the Phulambri Police Station and has contended that lawn is booked for wedding ceremony of Kajal. 6.
Learned Advocate for the victim submitted that the applicant may not be released on the bail, since the victim who was only 10 years old and is residing adjacent to the house of the applicant.

I have gone through the record of the case. Wedding ceremony of the younger sister of the applicant is fixed on 26-012026 and wedding invitation card is also filed on record. Even the learned APP has taken necessary instructions from the concerned police station which supports the contention made by the learned Advocate for the applicant.

Considering the fact that the marriage of younger sister of the applicant is fixed, I am inclined to release the applicant on temporary bail for a period of three days though the applicant has prayed for 15 days. Hence, the following order:
ORDER
a] The criminal application is allowed.
b] The applicant shall be released on 25-01-2026 on temporary bail, on furnishing PR bond of Rs.25,000/- [Rupees Twenty Five Thousand Only] with surety in the like amount.
c] The applicant shall attend the CIDCO-N-7 Police Station, Dist. Chhatrapati Sambhajinagar at 10.00 am every morning from 25-01-2026 till 27-01-2026. d] The applicant shall surrender on 27-01-2026 at 01.00 pm.
e] The applicant shall not pressurize or threaten the victim.
