CORAM : RAJNISH R. VYAS, J.

DATE : 26th FEBRUARY, 2026 PER COURT :

.

This is an application for condonation of delay of 64 days in filing the appeal, challenging the conviction awarded under Sections 363 and 376(3) of the Indian Penal Code, so also under Section 3 punishable under Section 4(2) of the Protection of Children from Sexual Offences Act. The maximum sentence awarded is twenty years.

2.

Learned counsel for the applicant submitted that due to some financial restraints, the appeal could not be preferred in time. 3.

Considering the fact that the applicant is sentenced for twenty years, I am inclined to allow the application. Criminal application is allowed. Delay is condoned. Appeal be registered.
