This is an application for grant of bail and suspension of sentence filed by original accused no. 2 - Sangitabai Gokul Patil, who was convicted for commission of offence punishable under Sections 363, 366-A, 506 read with 34 of the Indian Penal Code. 2.
The maximum sentence imposed upon accused no. 2 is two years and fine amount. All the sentences were ordered to run concurrently.

Learned counsel for the applicant/original accused no. 2 stated that she has deposited the fine amount and all through out the trial she was on bail and she did not misuse her liberty. He further submitted that she was already acquitted from commission of offence punishable
2 5Bail.odt under the Protection of Children from Sexual Offences Act, 2012, and, therefore, he contends that she may be released on bail. 4.
Per contra, learned APP opposes the application. 5.
Having regard to the fact that sentence imposed upon the applicant/original accused no. 2 is of fixed term and she is already acquitted for commission of offence from offence punishable under the Protection of Children from Sexual Offences Act, 2012, present application needs to be allowed. It is further necessary to note that after pronouncement of judgment of conviction original accused no. 2 had surrendered to the custody of the trial Court and preferred an application for grant of bail and suspension of sentence which was allowed.Considering the fact that arguable points are involved, I am inclined to allow the present application. Accordingly, following order is passed :
ORDER
i.
Application is allowed.
ii.
The sentence imposed by Special Judge (POCSO), Jalgaon, on 07.01.2026, in Special Case No. 241/2022, of two years on the accused no. 2, Sangitabai Gokul Patil for commission of offence punishable under Sections 363, 366A, 506 read with 34 of IPC, shall stands suspended till

iii.
The applicant / original accused no. 2 - Sangitabai Gokul Patil, be released on bail on same terms and conditions as were imposed by the trial Court. iv.
Application is disposed of.
