The present application has been filed for relaxation of the condition No.6 not to enter village Jomegaon (Usmannagar), Taluka Loha, District Nanded, imposed by the learned Additional Sessions Judge, Kandhar by order dated 29/8/2025, passed in Misc. Cri. Bail Appln. No.146/2025. 2.

Learned counsel for the applicants submits that, the marriage of applicant No.1 is scheduled to be held on 6/2/2/206. The applicants are agriculturists and they have not

committed breach of any conditions. The learned Additional Sessions Judge, Kandhar, by order dated 7/1/2026, passed below Exh.10 in Sessions Case No.33/2025, permitted the applicants to visit village Jomegaon between 5/2/2026 to 7/2/2026. Therefore, prayed to relax the condition No.6 imposed by learned Additional Sessions Judge. 3.

Learned A.P.P., on instructions, confirms that there is no breach of any of the conditions at the instance of the present applicants.

The marriage of the applicant No.1 is scheduled on 6/2/2026, coupled with the fact that the applicants are agriculturists, and further considering the number of witnesses, the prosecution seeks to examine, the trial is unlikely to conclude within a reasonable period.

In view of the aforesaid, the Criminal Application is allowed. The condition No.6 of the order dated 29/8/2025 passed in Misc. Cri. Bail Appln. No.146/2025 is relaxed. 5.
