This is an application for condonation of delay of 128 days caused in preferring the appeal challenging the judgment of conviction dated 01-07-2025 passed by the Additional Sessions Judge, Dhule in Sessions Case No. 40/2017 for the commission of offences punishable under Sections 307, 324 & 323 of the IPC. The maximum sentence is of 5 years.

The learned Advocate for the applicant submitted that since the applicant is a poor person he could not file the appeal within time bound period.

I have gone through the pleadings made in the application and have given my thoughtful consideration to the arguments advanced. Since the conviction is of 5 years and delay of 128 days I am inclined to allow the application. Accordingly, the application is allowed. The delay is condoned. 5.
