Applicant seeks relaxation of condition imposed by this Court, prohibiting him to enter Chikalthana Police Station during pendency of the trial.

Learned counsel for the applicant submits that his father is co-accused and behind bars. His younger brother Yogesh who is also co-accused is unable to cultivate the lands. They are agriculturists and cultivation is not possible as male members are unable to enter Chikalthana.

Learned APP submits that allegations are serious in nature. The disputes are bound to be there if the applicant enters Chikalthana jurisdiction and tries to cultivate the land.

Applicant and his father were armed with the weapon and he is likely to cause danger to the informant and the witnesses. Applicant is agriculturist. His father is in jail. His younger brother though released on bail is not in a position to cultivate. Applicant was enlarged on bail vide order dated 11.07.2025. There is no report of violation of any conditions imposed by this Court. One opportunity needs to be given by trusting the applicant and relaxing the condition. 6.
For the reasons stated above, Condition No.(b) incorporated in paragraph No.10 of the order dated 11.07.2025 shall stand relaxed on following conditions. (i) Applicant shall not indulge in any dispute or the overt act as against the informant and the witnesses.
(ii) Any breach of the order passed today shall entail revocation of relaxation.
