The applicant has filed the present application, thereby praying for permission to travel abroad from 21.03.2026 to 30.03.2026 to visit New-york (USA) and Toranto (Canada) for business purposes. 2.

The said permission is sought in view of the condition imposed by this Court vide interim order dated 7.10.2025, passed in A.B.A No. 1766 of 2025, wherein, the applicant was put to a condition that he shall not leave the country without the permission of this Court. 3.

The learned counsel for the applicant submits that the Investigating Officer had freezed the entire accounts of the applicant company and as such, the applicant was required to file an application for de-freezing the account of the Company i.e. OFB Tech. Private Limited. Accordingly, the learned Judicial Magistrate First Class vide order dated 11.12.2025 has allowed the application and directed the

{2} Investigating Officer to issue a release letter to the concerned Bank Manager so as to de-freeze all the bank accounts of the applicant company, which are freezed in Crime No. 76 of 2025, registered with M.I.D.C. Police Station, on a condition that the applicant company shall execute an Indemnity Bond of Rs. 2,77,10,488/- (Two Crores Seventy Sevan Lakhs ten thousand four hundred eighty eight) and Bank Guarantee of the like amount to secure the amount allegedly involved in the crime.

Thus, the applicant prays for permission to leave the country during the pendency of the present application as he is ready to abide by any condition that maybe imposed by this Court. 5.

This Court vide order dated 19.12.2025 had therefore, inquired from the applicant, as to whether the company has executed the Indemnity Bond and furnished the bank guarantee as per the order dated 11.12.2025 passed by the learned Judicial Magistrate First Class, Court No.5, Latur.

On 24th December, 2025, the learned counsel for the applicant has tendered across the bar, a copy of the Indemnity Bond executed by the company as directed by the learned J.M.F.C. , Latur and had also furnished the bank guarantee of like amount i.e. Rs. 2,77,10,488/- issued by the ICICI, Bnk, M.G. Road, Gurgaon. The same is taken on record and marked as "X" for the purpose of identification.Thus, the conditions imposed by the learned J.M.F.C. court No.5, Latur while defreezing the accounts stand complied with. 7.

The learned APP vehemently opposes the application. 8.

The learned Assisting Counsel though opposes the request

{3} made by the applicant, the apprehension of learned counsel for the complainant can be taken care of, by imposing further conditions, while allowing the applicant to leave the country. The applicant has already placed on record a copy of the air tickets for travel to New York and Torranto.

Taking into consideration the above submissions, coupled with the fact that the bank guarantee of the amount involved in the crime is already given alongwith Indemnity Bond. This Court has earlier allowed the application for permission to leave the country vide order dated 24.12.2025. Thus, on the same grounds and conditions, I am inclined to allow the present application. Hence, the following order :-

O R D E R

[A] The application is allowed;

[B] The applicant is permitted to travel abroad from 21.03.2026 to 30.03.2026 to visit USA and Canada. [C] The applicant shall furnish his entire programme of travel/itinerary to the Investigating Officer alongwith telephone/mobile numbers on which the applicant would be available and the place of his stay in Dubai and Moscow. [D] After his return to the country, the applicant shall attend the concerned police station on 3rd and 4th April, 2026 between 11.00 a.m. to 2.00 p.m.

[E] Stand over to 6th April, 2026.

[F] The application is disposed of accordingly.
