The above Criminal Revision Application is filed challenging the order conviction dated 09.01.2023 passed by learned JMFC (Court No.12), Aurangabad in SCC No. 9735 of 2019, for offence under Section 138 of the Negotiable Instruments Act, 1881 (NI Act) which

-2order has been confirmed by the Additional Sessions Judge, Aurangabad in Criminal Appeal No. 19 of 2023. 2.

Respondent Sambhaji s/o Rajabhau Kumbhar, i.e. original complainant in SCC. No. 9735 of 2019, is present in court today. He submits that he has no grievance left and he also has no objection for disposing the matter as settled. Consent terms/compromise pursis dated 11.03.2026 between the parties is placed on record. The same is taken on record and marked "X" for identification. 3.

Both, learned counsel for Revision Petitioner and learned counsel for respondent, are present in Court. They also unanimously submit that the matter has been settled. In view of the settlement, the following order is passed :

ORDER

I.

Criminal Revision Applications is disposed off as settled in terms of the consent terms/compromise pursis. II.

The impugned order dated 09.01.2023 passed by learned JMFC (Court No.12), Aurangabad in SCC No. 9735 of 2019, which is confirmed by the Additional Sessions Judge, Aurangabad in Criminal Appeal No. 19 of 2023, is hereby set aside.

III.

Revision Petitioner-Accused Bhausaheb s/o Ramrao Jadhav stands acquitted of the offence under Section 138 of the NI Act.

Revision Petitioner-Accused Bhausaheb s/o Ramrao Jadhav, who is reported to be behind bars, be released forthwith, if not required in any other crime.

V.

As there is said to be marriage in the family of accused, learned APP is requested to communicate this order to the concerned police/jail authorities today itself.

VI.
