Instant application is for suspension of sentence awarded by learned Special Judge, CBI Court, Aurangabad in Special Case ACB No.10 of 2007 dated 09-02-2026.

Learned counsel for applicant pointed out that applicant was chargesheeted and tried for offence under Sections 120-B,
{2} CRI APPLN 1022 OF 2026 420 of the Indian Penal Code 7, 13(1)(d) read with 13(2) of the Prevention of Corruption Act and on trial, came to be convicted for said offence vide above judgment. That, maximum sentence is of two years. That, appeal has been preferred against said order of conviction very recently and therefore, there are no immediate prospects of hearing the appeal. It is further submitted that, during trial applicant was on bail. That, fine amount has already paid and hence, it is prayed that during pendency of appeal, sentence be suspended and applicant be granted bail.

Learned APP opposed on the ground that on full-fledge trial, there is conviction and that sentence awarded is also two years for one of the offences. On such grounds, he opposed the relief.

Present application is for suspension of sentence awarded by judgment and order dated 09-02-2026 during pendency of appeal. Therefore, appeal is recent one and as such, there are no immediate prospects of hearing the appeal. Applicant is a
{3} CRI APPLN 1022 OF 2026 retired public servant and moreover, he was on bail during trial. Fine amount is said to be paid. For above reasons, relief as prayed deserves to be granted.
ORDER
(i) Criminal Application is allowed.
(ii) The substantive sentence imposed on the applicant - Ganpat s/o. Pandharinath Bhokare by the learned Special Judge, CBI Court, Aurangabad, in Special Case ACB No.10 of 2007 dated 09-02-2026 stands suspended till final hearing and disposal of Criminal Appeal No.186 of 2026.
(iii) The applicant be released on P.R. Bond of Rs.15,000/- (Rs.Fifteen thousand only) with two solvent sureties in the like amount.
(iv) The applicant shall not commit any criminal activity.
(v) The applicant shall remain present before the learned trial Judge once in six months, till final hearing and disposal of the appeal, commencing from the date he tenders bail papers and thereafter, the trial Judge to fix dates for his subsequent appearances.
{4} CRI APPLN 1022 OF 2026 (vi) In case of two consecutive defaults on the part of the applicant to remain present before the trial Court, the trial Court to inform this Court about the same and in that eventuality, the prosecution would be at liberty to file an application for cancellation of the bail granted to the applicant.
(vii) Bail before the trial Court.
