Heard learned advocate appearing for applicant. 2.
The applicant seeks restoration of Criminal Application No.2876 of 2025, which has been dismissed vide order dated 16.01.2026 for non-removal of office objections/non-complying order of this Court. The record indicates that on 06.10.2025, applicant was granted leave to amend application but amendment was not carried out within time. This Court by order dated 17.11.2025 and 15.12.2025 extended time to carry out amendment. Lastly, on 16.01.2026, conditional order was passed to carry out amendment within a period of four weeks. Inspite of that, order was not complied. Consequently, application was dismissed. 3.
Learned advocate appearing for applicant submits that although on 06.10.2025 order was passed permitting amendment, he
923-appln-1065-2026.odt (2) could not receive copy of charge sheet till November, 2025 and thereafter, inadvertently amendment could not be carried out. 4.
Considering submissions advanced and reasons as stated in application, application is allowed subject to condition that applicant carries out amendment within a period of two weeks from today and removes all office objections and further pays cost of Rs.1,000/- to Advocate's Association Bar Library, High Court, Aurangabad.
