Instant application is for suspension of sentence and grant of bail by virtue of judgment and order of conviction dated 03.02.2026 passed by learned Additional Sessions Judge, Ahmednagar in Sessions Case No. 364 of 2022 convicting the applicant for offence under Sections 353, 332, 341, 504, 506 r/w 34 of IPC.

Learned counsel submits that applicant was tried and convicted for above offence vide judgment and order dated 03.02.2026. That, maximum sentence awarded is of six months. That, appeal has been preferred against the same. That, there are no immediate prospects of hearing the appeal in near future, and as much more time would be required to hear the appeal, he urges for suspension of sentence and grant of bail.

Learned APP opposes on the ground that on full-fledge trial and on complete analysis of the evidence, guilt has been recorded for commission of above offences against a public servant. 4.

After considering above submissions and taking into account the quantum of sentence, i.e. maximum six months, this Court is inclined to grant the relief as prayed. Hence, the following order :

ORDER

I.

Criminal Application No. 1036 of 2026 stands allowed. II.

The substantive sentence imposed on the applicant Tejas s/o Pandurang Waman in Sessions Case No. 364 of 2022 by the Additional Sessions Judge, Ahmednagar on 03.02.2026 stands suspended till the final hearing and disposal of Criminal Appeal No. 203 of 2026.

The applicant be released on P.R. Bond of Rs.15,000/- (Rupees Fifteen Thousand Only) with two solvent sureties in the like amount.

The applicant shall not commit any criminal activity. V.

The applicant shall remain present before the learned trial Judge once in six months, till final hearing and disposal of the appeal, commencing from the date he tenders bail papers and thereafter, the trial Judge to fix dates for his subsequent appearances. VI.

In case of two consecutive defaults on the part of the applicant to remain present before the trial court, the trial court to inform this court about the same and in that eventuality, the prosecution would be at liberty to file an application for cancellation of bail granted to the applicant. VII. Bail before the trial court.

VIII. Criminal Application No. 1069 of 2026 is accordingly disposed off.

Appeal is admitted.
