Shersing Ambu Indrekar v. The State Of Maharashtra
2026:BHC-AUG:20295 -1- 904-APPLN-1294-2026
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD CRIMINAL APPLICATION NO. 1294 OF 2026 IN APEAL/418/2025 SHERSING AMBU INDREKAR
VERSUS
THE STATE OF MAHARASHTRA ......
Advocate for Applicant : Ms. Rashmi S. Kulkarni APP for Respondent - State : Mr. B. B. Bhise ......
CORAM : ABHAY S. WAGHWASE, J.
DATED : 05 MAY 2026 PER COURT :
1.
This Court had passed an order in this Application granting temporary bail to enable the prison - applicant to attend the marriage of his both the nephews. In consequence to the order of this Court dated 21.04.2026, police authorities conveyed the necessary charges to be paid for the escort/police guard. However, because of financial inability, the applicant could not pay the said charges and consequently, he missed the marriage of his one of the nephew, which was to be held on 26.04.2026. 2.
Learned counsel pointed to this Court that the charges are exorbitant and no basis for the levied charges is reflected in the communication received from the Commissioner of Police, Chhatrapati Sambhajinagar. Upon which, this Court called police personnel from
-2- 904-APPLN-1294-2026 Commissionerate Office through the learned APP and they placed a Government Resolution dated 06.05.2019 and the submission is made across the bar by the learned APP that the said Government Resolution is applicable in all cases of police protection as well as escort to prisoners. 3.
Learned counsel Ms. Rashmi Kulkarni would point out that, charges are exorbitant and applicant cannot even pay a day charges as well as charges for conveyance, and therefore, she prays to pass necessary orders and because of inability to pay the charges earlier order has become infructuous.
4.
In view of the above, no further orders are required, as the Criminal Application has already been disposed of. (ABHAY S. WAGHWASE, J.) Tandale
