The Applicants have filed this Application to condone the delay of 83 days in filing the Criminal Appeal, for which the learned Advocate for the Respondent No. 2 has given no objection. However, the learned APP opposed condoning the delay.

However, considering the reasons disclosed in paragraphs nos. 2 to 5, I deem it appropriate to condone the delay. It would not cause prejudice to the other side. On the contrary, the Applicants would get the opportunity to contest the matter on the merits. 3.

In view of the same, the Application is allowed in terms of prayer clause 'B'.
