The Applications for Assist to Public Prosecutor are allowed.

The applicants have approached this Court seeking regular bail in connection with FIR dated 29.03.2026 bearing Crime No. 0150 of 2026 registered with Chikalthan Police Station, Chhatrapati Sambhajinagar for the offences punishable under Sections 109, 115, 189(2), 190, 191(2), 191(3), 351(2), 351(3), 352 of Bhartiya Nyaya Sanhita, 2023.

The prosecution case is that the first information report was registered with an alllegation that on 28.03.2026 at about 01:30 p.m. the applicant and co-accused assaulted the informant with an intent to kill. It is further alleged that co-accused Sohel assaulted with sword, co-

-3accused Abuzer assaulted with knife and applicant gave fists blow. 4.

The learned counsel for the applicants submit that the applicants are falsely implicated in the crime. There is an unexplained delay in registration of the FIR. The applicants are not named in the FIR and has surfaced during the investigation. There is absence of motive on the part of the applicants. The investigation is complete and chargesheet is filed. 5.

Per contra, the learned APP and learned counsel for the informant / intervenor have opposed the application submitting that the investigation is under progress. The offence is serious in nature and there is likelihood of the applicants not cooperating with the investigating agency. Hence, prayed to reject the applications. 6.

Having heard the submissions from both the sides and upon perusal of the record indicates that the applicants are young men aged 24 and 21 years respectively and have no criminal antecedents. The primary allegations regarding the offences particularly the offence under Section 109 of the BNS are levelled against the co-accused while the applicants are alleged to have been the part of mob present at the time of incident. Apart from the same, prima facie, in absence of

-4specific role / allegations against the applicants, same entails the applicants to be admitted to bail.

Further perusal of the record indicates that the applicants were granted interim bail by this court and were directed to cooperate with the investigating agency and the same appears to have complied with. As such, I hereby direct that the applicants - PRAVIN RAJU CHAVAN, GAURAV DINKAR HUSE be released on bail on the conditions as deemed appropriate by the concerned trial court. 8.

In view of the aforesaid terms, the Bail Applications stand allowed.
