Learned counsel for the petitioner submits that both the petitions are filed by the same petitioner. Learned counsel fairly admits that the claim of the petitioner, pursuant to the amendment allowed by the learned JMFC in the proceedings under the Protection of Women from Domestic Violence Act, is restricted to residential rights in two rooms of the shared household situated at Nashik. It is Jhs/ 1/2

927 CRI WP NO. 22 OF 2026 further submitted that the other amendment was sought only to implead the subsequent purchaser, namely the nephew of the husband, in whose favour the sale deed was executed, allegedly with an intention to defeat the residential rights of the petitioner. 3.

Taking into consideration the aforesaid submissions, issue notice to the respondents, returnable on 09.02.2026. Learned APP waives notice on behalf of Respondent No. 1 - State. Learned counsel Mr. Suryawanshi waives notice on behalf of Respondent No. 2. The parties are put to notice that the matters shall be taken up for final disposal at the stage of admission.
