Learned counsel for petitioner Mr. Salgare informs that the learned Chief Judicial Magistrate vide its order dated 4.12.2024 has awarded final maintenance in favour of the wife, who has filed a proceeding under the Domestic Violence Act, baring No. PWDVA No.72 of 2019 granting Rs. 8000/- towards maintenance to the respondent wife from the date of filing the said proceeding.

Being aggrieved thereby, the petitioner filed an application before the learned district Judge, Aurangabad by filing PWDV Appeal No. 1 of 2025. During the pendency of the said appeal, the learned Appellate Court vide interim order dated 21.5.2025 has stayed the order passed by the Chief Judicial Magistrate in the domestic violence proceeding granting final maintenance, on the condition of petitioner depositing an amount Rs. 4,000/- p.m. and lump sum amount of Rs. 2,50,000/- to show his bonafides. The learned counsel for petitioner informs that in view of the interim order passed by the Appellate Court , the petitioner has deposited Rs. 2,50,000/- before the trial court and Rs. 24,000/- before the Sessions Court. The applicant is also regularly paying the amount of Rs. 4,000/- as per the interim order passed by the learned Sessions Court in appeal. 5.
Taking into consideration the aforesaid submission, there shall be interim relief in terms of prayer clause C, which reads thus :- "Pending hearing and final disposal of this Writ Petition, the impugned Order dated 4.12.2024 in P.W.D.V.A. Application No. 72 of 2019 passed by learned Additional Chief Judicial Magistrate, Dharashiv and order dated 14.11.2025 in P.W.D.V. Appeal No. 01/2025 passed by learned Additional Sessions Judge, Osmanabad may kindly be stayed" 6.
The above interim relief shall be subject to the condition that the petitioner shall continue to pay Rs. 4,000/- p.m. towards maintenance as directed by the learned first appellate court vide order dated 21.5.2025.
