Learned APP by placing reliance on the Judgment of the Hon'ble Apex Court in the case of Pradnya Pranjal Kulkarni vs. State of Maharashtra and Another reported in 2025 SCC Online 1948 submits that the present petition challenging the order of Judicial Officer is not maintainable under Article 226 of the Constitution of India. He submitted for that purpose Section 482 of Cr.P.C (Section 528 of BNSS) is to be invoked before the learned Single Judge. The learned counsel for the petitioner seeks time to take further recourse to the appropriate provision. Stand over to 13.03.2026.
