2026:BHC-AUG:3923 {1} 901 sr.no..odt
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD CRIMINAL WRIT PETITION NO. 148 OF 2026 Bhagwan Kashiram Kolhe And Another ....Petitioner
VERSUS
The State Of Maharashtra And Another .....Respondent .....
Advocate for the Petitioner : Mr. Ghanekar Nilesh S. APP for Respondents: Mr. R.K. Ingole.
CORAM : MEHROZ K. PATHAN, J.
DATE : 30th JANUARY, 2026.
P.C. :- 1.
Heard Mr. Ghanekar, learned counsel for the petitioners. The matter was heard on 28.1.2026 and notices were issued to complainant. The learned APP was also requested to inform the complainant - respondent No.2 herein about the present proceedings. The learned APP informs that the Investigating Officer has already informed the complainant about the present proceedings. The copy of the intimation given to the respondent No.2 - informant is taken on record and marked "X-1" for the purpose of identification. 2.
Taking into consideration the reasons mentioned in the application, this Court has already noted down the urgency in the matter that the petitioner No.1 was already allowed by the trial court to enter Kannad Taluka for the purpose of filing nomination for Election of the Zilla Parishad, on 21.1.2026. It can be seen from the record that the petitioner Nos. 1 and 2 are already released on regular bail, after considering the merits of the charges against them with the condition of not entering Kannad Taluka.
{2} 901 sr.no..odt 3.
The petitioner No.1 has already filled up the form for contesting the election of Zilla Parishad on 21.1.2026 as per the order dated 20.1.2026 passed by the trial court. As the relaxation is sought only for a limited period, I am inclined to allow both the petitioners to enter Kannad Taluka, however, only till 7th February, 2026. The writ petition is allowed in aforesaid terms and disposed of accordingly. [MEHROZ K. PATHAN] JUDGE.
