Though the learned Counsel for the petitioner submits that offence be registered against one Vijay Thombre, who had lodged false FIR against the petitioner, the appropriate remedy is to file a suit for damages for such malicious prosecution, as well as private complaint for the alleged defamation of the petitioner. 3.

Such remedy is available to the petitioner. As such, we are not inclined to grant any relief in this petition. On the contrary, the petitioner may pursue the aforesaid alternate remedy as permissible in the law in respect of his defamation as well as demand of compensation.

With this, we dispose of the petition.
