IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD CRIMINAL WRIT PETITION NO. 266 OF 2026 DIGAMBAR ANANDRAO PINGLE

VERSUS

SANTOSH KARWA AND ANOTHER ...

Advocate for Petitioner : Mr. Ashutosh C Sisodiya ...

CORAM : MEHROZ K. PATHAN, J.

DATE : 11th MARCH 2026 PER COURT :

1.

At the outset, the learned Counsel for the Petitioner seeks permission to withdraw the petition, as this Court was not inclined to entertain the Writ Petition against the order of issuance of process passed in the year 2016, on the ground that an alternate remedy of filing a Revision is available to the Petitioner. 2.

Insofar as the other prayer for setting aside the proclamation is concerned, the learned Counsel for the Petitioner submits that the application for cancellation of the proclamation order, Exhibit-92, is yet to be decided by the learned trial Court, i.e., the Additional Chief Judicial Magistrate, Sangamner, and is pending adjudication.

3.

Taking into consideration the aforesaid submissions and the Roznama produced on record, the learned Additional Chief Judicial

2 908.Cri.WP-266-2026.doc Magistrate, Sangamner, is requested to make an endeavour to decide the application for cancellation of the proclamation filed by the Petitioner, on its own merits, within a period of two weeks from the date of receipt of this order.

4.

The Criminal Writ Petition stands disposed of as withdrawn. MEHROZ K. PATHAN JUDGE NAJEEB..
