By way of this petition, the petitioner seeks a direction to Respondent Nos. 2 to 4 to maintain law and order and also to decide its representations dated 13/02/2015, 21/02/2025 and 09/01/2026.

However, the learned APP, on instructions, submits that the Wakf Tribunal has already granted interim relief in favor of the petitioner in respect of Shri Buwa Sindibaba Alias Sayyad Ahmed Chishti Awaliya Dargah (Trut Ruhari (Bk.), Rahuri, Taluka: Rahuri, District: Ahilyanagar). The concerned police officer has also submitted that it is a dispute of civil nature and therefore, the Wakf Tribunal, which is competent to decide the matter, can pass the necessary directions if the petitioner remains aggrieved.

Learned counsel for the petitioner has admitted that the Wakf Tribunal has granted interim relief to the petitioner for a similar request. We are of the view that the correct approach for obtaining the relief claimed in this writ petition is to approach the concerned Tribunal for implementation of the interim order. Only upon filing such application, the Wakf Tribunal will be able to pass an appropriate order in accordance with law, including the grant of police protection, if necessary.

In view of the above, the writ petition is disposed of with liberty to the petitioner to approach the Wakf Tribunal for redressal of his grievance. The writ petition accordingly stands disposed of. ( ABASAHEB D. SHINDE, J. ) ( SANDIPKUMAR C. MORE, J. ) VS Maind/-
