CORAM : S. G. CHAPALGAONKAR, J.
(VACATION COURT) DATE : 29th MAY, 2026.
P.C:- 1.
The present Writ Petition is filed seeking Writ of Habeas Corpus against respondent nos.1 to 4 to produce petitioner's wife namely Sanskruti Khanderao Bhatlavande @ Sanskruit Pradip Diwane before this Court and to hand over her custody to petitioner.
2.
The petitioner contends that petitioner married with Sanskruti on 04.05.2026 at Ridhi Sidhi Mangal Karyalay, Alandi, District Pune. The certificate of marriage is placed on record alongwith photographs of marriage ceremony. According to petitioner, on 10.05.2026 petitioner and his wife Sanskruti filed complaint to Police Station Yermala seeking protection from family members and relatives of Sanskruti. The respondent nos.5 and 6 detained Sanskruti. Hence, present Writ Petition.
(2) cri.wp-648-2026 3.
Today petitioner's wife Sanskruti is brought before this Court. I have personally interacted with her in chamber to find out her wish. She expressed her reservation to live with petitioner and wants to reside with respondent no.5/her father. Apparently, Sanskruti is major and confirmed before this Court that she is residing with her father as per her wish. She is not subjected to coercion or pressure by any one. She wants to continue her studies by residing with her parents. 4.
In light of willingness of Sanskruti, there is no reason to entertain petitioner's prayer to direct respondent nos.1 to 4 to hand over her custody to petitioner.
5.
Stand over to 11.06.2026.
6.
The respondent nos.1 to 4 shall ensure presence of Sanskruti before this Court on next date.
