IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 907 CRIMINAL APPEAL NO. 8 OF 2026 Surekha Bhagwat Kachare
VERSUS
The State Of Maharashtra And Another ...
Mr. Shekade Shashikant E, Advocate for Appellant Mr. V. M. Chate, APP for Respondents State CORAM : Y. G. KHOBRAGADE, J.
Dated : 7th January, 2026 PER COURT :- 1.
Heard learned counsel for the appellant.
2.
Issue notice to the respondents, returnable on 21.01.2026. Leaned APP waives notice on behalf of Respondent No.1 State.
3.
In addition to regular mode, the appellant is permitted to serve Respondent No.2 privately, by any permissible mode. 4.
On face of record, it appears that the present appeal is directed against the judgment and order dated 17.12.2025 passed by the learned Special Court, Beed in Criminal Bail Application No. 1184 of 2025, whereby, rejected the prayer for grant of anticipatory bail to the appellant and other co-accused in connection with Crime No. 334 of 2025 registered with Peth Beed
Police Station, Dist. Beed for the offences punishable under sections 115(2), 352,351(2), 3(5), 85 of the Bhartiya Nyaya Sanhita and under sections 3(1)(r), 3(1)(s), 3(2)(va) of the Schedule Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
5.
The learned counsel for the appellant invited my attention to order dated 26th December, 2025 passed by this Court in Criminal Appeal No.987 of 2025 in vacation, wherein the other co-accused are released on pre-arrest bail on furnishing P.R. bond of Rs.50,000/- with two solvent sureties in the like amount. 6.
Considering the contention of the FIR, the role played by the present appellant appears that prior to 2023, the present appellant/accused had abused the complainant on her caste. Therefore, considering the nature of offence and the role played by the present appellant, it would be just and proper to enlarge the appellant on pre-arrest bail till next date. Hence, I proceed to pass following order:
O R D E R
In the event of arrest of the appellant Surekha Bhagwat Kachare in connection with Crime No. 334 of 2025 registered with Peth Beed Police Station, Dist. Beed, she shall be released on bail
upon furnishing P.R. Bond of Rs.50,000/-[Rupees Fifty Thousand only] with two solvent sureties in the like amount till next date, on following conditions:
