This is the criminal appeal challenging the judgment of conviction under the provisions of Indian Penal Code and acquittal under the provisions of Scheduled Castes and Scheduled Tribes (Protection from Atrocities) Act, 1989.

Learned counsel for the appellant fairly submits that he has remedy of preferring appeal under Section 14-A of the Scheduled Castes and Scheduled Tribes (Protection from Atrocities) Act, 1989. He seeks permission to withdraw the present appeal and file fresh appeal under the relevant provisions.
