Heard Mr. Gangakhedkar Shailendra S., learned Counsel for the appellants and Mr. Kulkarni, learned APP for the Respondent State at length.

By the present appeal, the appellant prays to quash and set aside the order dated 18.12.2025, passed below Exhibit 01, by the

learned Additional Sessions Judge -1, Nanded, District Nanded in Criminal Bail Application No. 967 of 2025. The appellant, further prays for grant of ad-interim protection in Crime No. 410 of 2023, registered on 13.12.2023, with Vimantal Police Station, Nanded, for the offence punishable under Sections 376 (2)(n), 313, 315, 323, 504, 34 of the Indian Penal Code (for short "IPC") and under Section 3(1)(r), 3(1)(s), 3(2), 3(v), 3(1)(w)(i), 3(1)(w)(ii) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

I have gone through the contents of the First Information Report (for short "FIR"). On the face of the FIR it appears that, accused No. 1, Harjeetsingh Pannu, on the false promise of marriage developed physical relations with the informant, and out of which, she was conceived and the accused No. 8, Shahabaj Shardulla, had supplied some pills to the accused No. 1 and some pills were administered by the accused No. 1 to the informant, due to which she aborted. So also accused Nos. 1 to 7 abused her in her caste. However, the place of abusing in the caste, is not described in the First Information Report. So also on 13.12.2023, FIR No. 410 of 2023 was registered with Vimantal Police Station and since then the present appellant is yet to be arrested. 4.

The appellant is the sister of the original accused. However, on perusal of the record it does not reveal that the respondent/informant disclose the name of present appellant in the First Information Report. However, in supplementary statement the informant discloses the name

of the present appellant.

Therefore, considering the nature of Crime, at this stage, I have satisfied that, the appellant has made out prima-facie case to enlarge her on ad-interim anticipatory bail till next date. In view of the above, I proceed to pass following order :

ORDER

(1) Issue notice to the respondents, returnable on 18.02.2026.

(2) The Investigating Officer, to serve respondent No. 3/Informant and submit the service report.

(3) Till next date, in the event of arrest, the appellant Rajvinderkaur w/o Ajeetsingh Chhatwal, be released on anticipatory bail on furnishing her PR bond of Rs. 50,000/- (Rs. Fifty Thousand Only), with one solvent surety in the like amount on following conditions :

(i) The appellant shall attend the concerned Investigating Officer on each Friday, in between 10.00 a.m. to 12.00 p.m.

(ii) The appellant is permanent residence of Sindhi Colony, Aurangbaad and the offences are registered with Vimaltal Police Station, Nanded, therefore, the appellant shall appear before the Investigating Officer, Vimaltal Police Station, Nanded, on every 15th and last date of every month, till filing of the Charge-sheet.

(iii) The appellant shall not issue any threats to the prosecution witnesses and shall not be tamper with the evidence.
