Heard the learned counsel for the appellant at length. 2.

By the present appeal, the appellant prays for anticipatory bail in Crime No. 357 of 2025, registered on 25.11.2025 with Itwara Police Station, District Nanded, for the offence punishable under Sections 108, 352, 351(3) of Bharatiya Nyaya Sanhite, under Section 3(1)(r), 3(2)(va), 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and also challenged the order dated 26.12.2025, passed by the learned Special Court under the Atrocities Act, whereby the learned trial Court declined to enlarge the present appellant / accused on bail.

On perusal of the F.I.R., it appears that the present appellant had provided some amount on interest to the son of informant and had obtained a bond of Rs.2,00,000/- (Rupees Two Lakh). So also, since past seven months, the present appellant was continuously visiting at the house of non-applicant No.2 and was abusing on the caste, so also damaged the house utensils. 4.

Since the learned trial Court passed the order on 26.12.2025 and the applicant approached this Court by filing the present appeal on 17.01.2026, therefore, it would be just and proper to call upon the Investigating Officer to file reply. In absence of reply of the Investigating Officer, the prayer for anticipatory bail cannot be decided.

Issue notice to the respondents, returnable on 27.01.2026.
