For the reasons recorded separately, following order is passed.

ORDER

a] The criminal appeal is allowed.

b] The judgment of conviction passed by learned Judge, Fast Track Court, Dharashiv in Sessions Case No. 53 of 2022 dated 31-12-2025, convicting the appellant for commission of offences punishable under Sections 376 and 323 of the Indian Penal Code is quashed and set aside.

(2) 29criapl39.26 c] The appellant is acquitted for the commission of offences punishable under Sections 376 and 323 of the Indian Penal Code.

d] The appellant be released forthwith.

e] The fine amount deposited, if any, be refunded to the appellant.

f] The R & P be sent back to the trial court.
