As per office note, the appellants have not furnished the address purshis of respondent no.3 in a sealed envelope, hence notice could not be issued to respondent no.3. However, the learned APP submitted that on 11.02.2026, the Investigating Officer, SDPO, Hingoli issued notice to Respondent No.3/Victim-informant and intimated that the present appeal is fixed before this Court for hearing on 13.02.2026 and the said notice is served upon Respondent No.3. 2.

In view of above, it can be held that there is service of notice upon respondent no.3.

Despite service, respondent no.3 failed to appear in the matter. Therefore, the learned Secretary, Legal Aid Sub-Committee, High Court, Aurangabad is directed to appoint a counsel from the panel to defend the cause on behalf of the respondent.
