During the course of the argument the learned counsel appearing for the appellant submits that, the appellant belongs to the scheduled caste community, so also, the informant-respondent No. 2 is from the scheduled tribe community, therefore, the offence under Sections 3(1)(r), 3(1)(s), 3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 does not apply. 2.

The learned counsel appearing for the appellant seeks time to file affidavit alongwith the caste certificates. 3.
