This Petition filed under Article 226 of the Constitution of India read with Sections 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for quashing of the proceedings of R.C.C. No.734 of 2022 registered on the basis of C.R. No.586 of 2021 registered with

Vijapur Naka Police Station, Solapur for the offences punishable under Sections 377, 420, 313, 498(A), 323, 504, 506 read with Section 34 of the Indian Penal Code, 1860 at the instance of Respondent No.2, who is the wife of Petitioner No.1 - Nilesh Mangrule.

The FIR appears to be lodged out of matrimonial dispute between Petitioner No.1 and Respondent No.2. Charge-sheet in the present crime is filed on 26.05.2022. During pendency of the present Petition, Petitioner No.1 and Respondent No.2 have amicably settled their matrimonial dispute. The affidavit is filed by Respondent No.2 stating that the matrimonial dispute between Petitioner No.1 and husband is amicably settled out of the Court with the intervention of elderly members of the family. They have decided to part their ways by obtaining divorce by mutual consent. They mutually agreed that Petitioner No.1 would pay the total amount of Rs.52,50,000/- as one time settlement as permanent alimony in three installments. Today, Demand Draft of Rs.20,00,000/- towards first installment is paid to the Respondent No.2 in the Court. The parties have further agreed to withdraw all the cases filed against each other and moved for divorce petition jointly. The remaining two installments will be paid in the divorce proceedings.

The parties are present before the Court. They are identified by their respective Advocates. They confirm the settlement of their dispute. The affidavit of second respondent is verified before the learned Registrar Judicial.

In view of the amicable settlement of matrimonial dispute between the parties, the continuation of criminal prosecution lodged at the instance of second respondent against the Petitioner, would be an abuse of process of law. The proceedings are therefore, quashed and set aside.

The Petition is disposed of accordingly.
