IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIRCUIT BENCH AT KOLHAPUR CRIMINAL WRIT PETITION NO.11 OF 2026 Kiran s/o. Appasaheb Shete vs.
The State of Maharashtra and ors.
---- Mr.Rupesh Jaiswal, Advocate a/w. Mr.Amit Waykool, Advocate for petitioner Mrs.S.N.Deshmukh, APP for respondents ---- CORAM : R. G. AVACHAT & AJIT B. KADETHANKAR, JJ.
DATE : JANUARY 21, 2026.
ORDER :- Vide order dated 27.11.2025 issued by the Jail Authority, the petitioner has been set on parole and was directed to surrender on or before 25.01.2026. Now, the petitioner prays for extension of time to surrender on account of his illness and the surgery which he has to undergo.
2.
Mr.Jaiswal, learned counsel for the petitioner, would demonstrate from page no.19 the illness of the petitioner and that the petitioner has been referred to the higher centre (hospital) for his surgery. Mr.Jaiswal submits that once the petitioner is operated, he would surrender as per the directions of this court.
7-sr908 3.
Learned APP strongly opposes the prayer for extension of parole leave and submits that the petitioner must surrender as per the order granting parole leave and should make separate application for such medical leave.
4.
Considering the reasons stated in the application and the documents annexed to the petition, we are inclined to grant the petitioner extension for surrender till 28.02.2026. 5.
Mr.Jaiswal, learned counsel, would submit that the entire medical record including the surgery procedure shall be submitted by the petitioner while surrendering to the jail authority. He submits that no further extension shall be sought by the petitioner. 6.
In view of the above, the Writ Petition stands disposed of. [AJIT B. KADETHANKAR, J.] [R.G. AVACHAT, J.] KBP
