Perusal of the record indicates that the parties entered into a settlement and executed a deed. The Appellate Court (Sessions Court) permitted parties to compound the offence under section 138 of the Negotiable Instruments Act, 1881 by taking on record an application seeking permission to compound as well as Talwalkar

15-17.WP34.2026.doc the settlement deed signed by the parties.

Mr. Santosh Thakur, learned Advocate for the Petitioners submits that the Respondent Accused has played fraud on the Petitioners. According to him, application for compounding and settlement deed was filed before the Sessions Court behind the back of the Petitioners. He however, does not dispute the contents of the Application and the Settlement Deed which the Sessions Court has referred to in its order dated 8th October, 2025. 3.

After arguing the matter for some time, Mr. Thorat, learned Advocate for the Petitioner requests for some time for making research. At his request, list the matter on 14th January, 2026.
