The present Petition, filed under Article 227 of the Constitution of India, challenges the order dated 18th November 2021 passed below Exhibit-1 in STC No. 869 of 2019. By the said order, the learned Judicial Magistrate First Class, Solapur, has issued process against the present petitioner/original accused for the offence punishable under Section 138 of the Negotiable Instruments Act, 1881.

Learned Counsel for the Petitioner submits that an alternate adn

36-WP-175-2026 remedy is available before the Revisional Court for challenging the order issuing process.

In view thereof, learned Counsel seeks permission to withdraw the Petition with liberty to avail of the appropriate remedy. 5.

The Petition is accordingly disposed of as withdrawn, with liberty as prayed for.

Needless to state that the liberty granted shall be in accordance with law.
